I. GENERAL INFORMATION

This privacy policy outlines the principles of processing personal data of users of the VOD platform, which refers to the VOD platform: https://vod.responsibleacademy.eu/. • The controller of personal data collected via the VOD platform is the Foundation for Economy and Public Administration (Fundacja Gospodarki i Administracji Publicznej), headquartered in Krakow at ul. ks. I. J. Skorupki 22, 31–519 Krakow, NIP: 676-22-93-050, REGON: 120037591, KRS: 0000232184 (hereinafter referred to as the "Controller"). • You can contact the Controller via email at [email protected] / [email protected], by phone at +48 12 423 76 05, or at the address specified above. Telephone inquiries are available Monday to Friday, from 9:00 AM to 3:00 PM. • Every entity using the VOD platform is considered a User. • The personal data of the VOD platform user is processed by the Controller in accordance with applicable law, particularly the General Data Protection Regulation (GDPR) (Regulation (EU) 2016/679 of the European Parliament and Council of April 27, 2016).

II. PURPOSES, LEGAL BASES, AND DATA PROCESSING PERIOD

The user's personal data may be processed by the Controller for the following purposes: • Registration on the VOD platform, • Managing user accounts on the VOD platform. The legal basis for processing the user's personal data for the purposes specified in points a and b above is the necessity to perform the agreement between the user and the Controller, as defined in the Terms of Service, and to take actions prior to entering into such an agreement (Art. 6(1)(b) GDPR). • As specified in the consents provided by the user for personal data processing. The legal basis for processing the user's personal data is their consent to process personal data (Art. 6(1)(a) GDPR). • Conducting marketing activities related to promoting the VOD platform and the Controller's activities, including sending newsletters about OEE events. • Conducting analytical and statistical activities related to the use of the VOD platform. • Establishing, defending, and asserting claims arising from the relationship between the user and the Controller. The legal basis for processing the user's personal data for the purposes specified in points d-f above is the realization of the Controller's legitimate interests, understood as marketing activities, conducting statistics/analyses, and establishing, defending, and asserting claims (Art. 6(1)(f) GDPR). Marketing activities conducted via email are carried out only after obtaining the user's consent to use the appropriate communication channel for such information. • To register on the VOD platform and manage a user account at https://vod.responsibleacademy.eu/, the user provides their name and email address. Providing this data is voluntary, but its absence makes it impossible to register, manage an account, or use the VOD platform. • To receive newsletters, promotional materials, event information, and for marketing purposes, the user provides their email address. Providing this information is voluntary but necessary for receiving marketing information, including newsletters. • Please note that it is not possible to use non-public services available in the private section of the Service anonymously, such as the Registration System and Platform. • The retention period for the user's personal data depends on the purpose for which the data is processed: • For purposes related to services provided by the Controller (point 1(a-b) above), the data will be processed during the provision of these services and after their completion, for the limitation period of claims. • For purposes based on consents for personal data processing provided by the user (point 1(c) above), the data will be processed until the consent is withdrawn. • For marketing activities (point 1(d) above), the data will be processed until an objection to processing is submitted, or, in the case of marketing conducted via email, until the consent to receive marketing content electronically is withdrawn. • For other purposes arising from the Controller's legitimate interests (point 1(e-f) above), the data will be processed until the user submits a justified objection, which is reviewed by the Controller. • The user's personal data will not be processed or subjected to profiling in a manner that could produce legal effects or otherwise significantly impact users.

III. RIGHTS OF DATA SUBJECTS

The user has the following rights: • The right to access data, including obtaining a copy of the data, • The right to request rectification of data, • The right to request data deletion (in specific situations), • The right to lodge a complaint with the supervisory authority responsible for personal data protection if they believe their data is not being processed in accordance with the law, • The right to restrict data processing, • The right to object to data processing for direct marketing purposes and profiling, as well as to data processing based on the legitimate interest of the Controller due to the user's particular situation. • If the user's data is processed based on consent or as part of a provided service (the data is necessary for the service), they also have the following rights: • The right to withdraw consent to the extent that the data is processed on that basis. Withdrawal of consent does not affect the legality of processing carried out before its withdrawal, • The right to data portability, i.e., to receive personal data from the Controller in a structured, commonly used, machine-readable format. You may transfer this data to another data controller. • More information about the rights of data subjects is available in Articles 15-23 of the GDPR, which can be found at: https://eur-lex.europa.eu/legal-content/EN/TXT/?uri=CELEX%3A32016R0679 • To exercise these rights, the user should contact the Controller at [email protected] or [email protected], or by phone at +48 12 423 76 05. Telephone inquiries are available Monday to Friday, from 9:00 AM to 3:00 PM. • Your request should, as far as possible, precisely indicate the nature of the request, i.e., the recipient of the request and the specific rights you wish to exercise. If the Controller is unable to determine the content of the request or identify the requester based on the submitted information, they may request additional details from you. • A response to your request will be provided promptly, no later than within one month of its receipt. If it becomes necessary to extend this period, you will be informed of the reasons for the extension. Responses will be provided in writing unless the request was submitted via email or you request an electronic response, in which case the reply will be sent to the email address you provided.

IV. DATA SHARING

Personal data is collected with due care and adequately protected against unauthorized access. • The user's personal data may also be disclosed to entities authorized to obtain it under applicable law, such as law enforcement authorities, in response to a legitimate request based on appropriate legal grounds (e.g., for the purposes of ongoing criminal proceedings). • Entities whose technologies are used (e.g., Google) or whose plugins are integrated into the service, particularly social media operators, may have access to the user's personal data stored in certain cookies, provided the user has given their consent.

V. DATA TRANSFER TO THIRD COUNTRIES

Personal data of the user may be transferred to countries outside the European Economic Area in connection with the Controller's use of service providers for tools supporting the operation of the VOD platform and conducting analytical and statistical activities by the Controller. To ensure an adequate level of protection, the Controller employs all possible measures to secure the transferred personal data, including, in particular, entering into standard contractual clauses issued by the European Commission and verifying the entities that may have access to the data. More information about the applied safeguards, including copies thereof, can be obtained from the Controller by contacting them as specified in point I, subsection 3 of the Privacy Policy.

VI. INFORMATION ABOUT COOKIES

The website uses cookies. • Cookies are IT data, particularly text files, stored on the end device of the VOD platform user and are intended for using the VOD platform. Cookies typically include the name of the website they originate from, the duration of their storage on the end device, and a unique number. • The information collected by cookies does not generally constitute personal data (they do not allow the user to be identified). However, some of this information, depending on its content and usage, may be attributed to a specific individual and therefore qualify as personal data. Such information is subject to the provisions of the Privacy Policy concerning personal data, with the legal basis for its processing being the legitimate interest of the Controller or a third party (Art. 6(1)(f) GDPR), understood as ensuring the proper functioning of the VOD platform and conducting statistics/analyses. • The Controller uses the following types of cookies on the VOD platform: • Session cookies – Temporary files stored on the user's device until the website is exited or the browser is closed; • Persistent cookies – Files stored on the user's device for a period specified in the cookie parameters or until the user deletes them; • Necessary cookies – Files essential for the functioning of the VOD platform, used to ensure its proper and secure operation; • Analytical and functional cookies – Files enabling: • Optimization of the VOD platform usage, particularly recognizing the user's device and appropriately displaying the website tailored to their individual needs; • Creating statistics and analyses to understand how users interact with the VOD platform, allowing improvements in its structure and content, as well as detecting abuse; • Marketing cookies – Files used to display advertisements tailored to the user's interests on the VOD platform. • The VOD platform uses both Controller's cookies and third-party cookies. • Google Analytics The VOD platform uses Google Analytics, a web analytics service provided by Google Inc. ("Google"). Google Analytics uses cookies stored on your computer, enabling the use of the VOD platform. Information on how the user interacts with the VOD platform is generally transmitted to and stored on Google's servers in the United States. The VOD platform uses IP anonymization. This means your IP address will be shortened by Google within EU member states or other countries in the European Economic Area before transmission. The full IP address will only be sent to Google's servers in the United States in exceptional cases. Google uses the transmitted information to analyze how you use the VOD platform, generate reports on VOD platform activity, and provide other services to the Controller related to the use of the VOD platform and the internet. The IP address identified by Google Analytics will not be associated with other data collected by Google. • Remarketing The VOD platform uses remarketing tools to display advertisements to you on Facebook (Facebook Pixel) and Google (Google Display Network). • Web beacons In addition to cookies, the VOD platform may collect data typically gathered by web administrators in the form of logs or files. Information contained in the logs may include your IP address, platform and browser type, internet service provider, and the website from which you accessed the VOD platform. Some subpages within the VOD platform may contain web beacons. Web beacons enable the collection of information such as the IP address of the computer on which the page was loaded, the URL of the page, the loading time, browser type, and information contained in cookies to evaluate the effectiveness of advertisements. • IP Address The Controller reserves the right to collect IP addresses of visitors to the VOD platform, which may assist in diagnosing technical issues with the server, creating statistical analyses (e.g., identifying regions with the most visits), and improving the administration and enhancement of the VOD platform. IP addresses are collected anonymously, meaning they are not linked to any user data. • In many cases, web browser software allows the storage of cookies on the user's end device by default. Users can modify their cookie settings at any time, particularly to block the automatic handling of cookies in the browser settings or to notify them each time cookies are placed on the user's device. Detailed information on managing cookies can be found in the browser settings. • Please note that restricting the use of cookies may affect some functionalities or prevent the use of certain resources on the VOD platform.

VII. FINAL PROVISIONS

Unregulated matters are governed by the Personal Data Protection Act and GDPR. • This policy is subject to periodic review and updates. • The Controller reserves the right to modify provisions without prior notice. The current policy is available at: https://vod.responsibleacademy.eu/.
